Phantom Fireworks Gets Green Light for Fort Myers Relocation
FORT MYERS, FL – 12th Judicial Circuit Court Judge Michael T. McHugh cleared the way Friday for Phantom Fireworks to relocate its retail consumer fireworks showroom from its former location in North Fort Myers to its present location at 16243 S. Tamiami Trail in Fort Myers.
A competitor filed suit last week seeking an injunction that would have prohibited Phantom from relocating to the Fort Myers location. Both Phantom Fireworks and Lee County were named as defendants in the lawsuit, which Judge McHugh rejected after a one and a half hour hearing Wednesday, noting in his decision that the competitor “failed to establish all of the elements required” for the injunction or mandamus.
Phantom Fireworks of Ft. Myers had been preparing to relocate its upgraded showroom to the Tamiami Trail location since construction on the new location began in March, but the lawsuit had put the move in question. Phantom was represented in the litigation by Atty. Brian Cheffer of the Roetzel & Andress Law Firm in Fort Myers.
“We are obviously pleased with Judge McHugh’s ruling,” said Rick Greenfield, Phantom Fireworks Retail Operations Director. “Our Fort Myers staff has been serving the Fort Myers community since Memorial Day, 2003 and will continue to do so in a larger, state of the art showroom.”
Phantom of Fort Myers’ new location on S. Tamiami Trail, one mile north of Alico Road, is a 6,000 square-foot facility that is fully sprinklered, more spacious than the old facility, has more exits, wider shopping aisles, fully handicapped accessible, separate entrances and exits, and a wider selection of fireworks products on display.
“With the threat of this lawsuit behind us, we are back on track now and open for business at this new showroom,” said Phantom showroom manager Jared Aponte. “Our relocated showroom offers the best fireworks shopping experience in the greater Fort Myers area.”
